IPOC drops DCA challenge

The Islandside Property Owners Coalition (IPOC) has filed a notice of voluntary dismissal in its appeal to the former Florida Department of Community Affairs (DCA) that challenged the Town Commission-approved changes to the town code that affected the Longboat Key Club and Resort’s proposed Islandside project.

The former DCA found that the amendments were in compliance with the Comprehensive Plan in September and filed a motion to voluntarily dismiss the administrative action against the town.

“While IPOC disputes that later adopted plan amendments cures inconsistency between an adopted land development regulation and the comprehensive plan pursuant to § 163.3212, IPOC sees little benefit in pursuing the claim and having the Town sanctioned for adopting the inconsistent land development regulations,” the notice states. “While IPOC also disputes that the Department could properly be dismissed from the proceedings rather than realigned with the Respondents, IPOC sees no benefit in pursuing this claim.”

The dismissal concludes all pending administrative actions, according to an email from town attorney David Persson, however, the writ of certiorari and de novo challenges remain in Sarasota County Court.
