Judge blesses Colony owners’ meeting

Owners are also scheduled to hear development presentations from the MW Development Group/The Lutgert Cos. and Unicorp President Chuck Whittall Dec. 15.

The Colony Beach & Tennis Resort Association’s annual owners meeting will start as scheduled 9 a.m. Dec. 15 on Longboat Key.

Sarasota County Judge Rochelle Curley entered an order Tuesday denying an injunction by a Unicorp National Development subsidiary, which asked Curley to prevent the Colony Beach & Tennis Resort Association from holding the owners meeting and other meetings until there’s full resolution of all the bankruptcy and legal issues surrounding the shuttered resort.

Unicorp Colony Units LLC filed the motion for a temporary injunction in the 12th Judicial Circuit Court Monday, seeking to halt upcoming meetings.

A new board is scheduled for election for the first time in more than two years at the meeting.

Owners are also scheduled to hear development presentations from the MW Development Group/The Lutgert Cos. and Unicorp President Chuck Whittall.

Whittall said he still intends to make a presentation “and make a significant offer to the owners” at the meeting. He declined to discuss why his legal team moved forward with an injunction to prevent the meeting, saying only that he “looks forward to moving forward with a redevelopment plan for the Colony.”
