UPDATE: Bob's Boathouse served with violation

Sarasota County Code Enforcement and the Sarasota County Sheriff's Office have outlined a plan to deal with complaints generated in neighborhoods around Bob's Boathouse.

The move for more monitoring of the recently relocated restaurant on South Tamiami Trail comes after its second violation of the County Code. Lighting at Bob's Boathouse exceeded thresholds set by the county, according to a Nov. 27 memo from Planning and Development Services Director Tom Polk.

Many of the emails from neighbors to Sarasota County commissioners have been in response to noise from Bob's Boathouse, though county staff and the Sheriff's Office haven't found any violations.

Moving ahead, Code Enforcement will conduct weekend and evening inspections and the Sheriff's Office will respond to complaints it receives. And Quest Technologies will train staff from both offices for sound-level meter reading.

Sarasota County commissioners have questioned the legal basis for the newly relocated restaurant's liquor license and neighbors have lodged noise complaints. And on Nov. 20, Sarasota County Code Enforcement filed a notice of violation ordering Bob's Boathouse to cease outdoor dining during prohibited hours.

The County Code permits outdoor dining from 6 a.m. to 10 p.m. Sunday through Thursday, and 6 a.m. to 11 p.m. on Friday and Saturday. The violation occurred Nov. 17, according to the notice.

Bob's Boathouse management will have until Dec. 1, to correct the violation or face a hearing with the Code Enforcement Special Magistrate that could result in fines.

Sarasota County Commissioner Nora Patterson in a Nov. 24 email echoed Commissioner Joe Barbetta's concerns about the distance between the restaurant and South Trail Church of Christ after seeing a picture of the code enforcement measurement. Barbetta had questioneded the method used to measure the 800-foot threshold from the front door of Bob's Boathouse to the adjacent church.

"If the green line in the attachment represents the path measured as supposedly the path that a pedestrian could follow to get over 800 feet I do not see how this passes the straight face test," Patterson wrote.
