The Zoning Board of Adjustment will hear complaints from Village resident and commission candidate Gene Jaleski Feb. 12.

In an attempt to appeal and rescind past approvals given to Mar Vista Dockside Restaurant & Pub, Jaleski wants the ZBA to rule on a complaint that states he has not received notification for zoning actions in regard to Mar Vista approvals for past projects over the last 20 to 25 years; that the Planning and Zoning Board didn’t give him sufficient time to speak at a past Mar Vista hearing; and that the special exception permit Mar Vista received in December should be rescinded because the PZB ruled in error.

The ZBA, however, will only be asked to make a single decision Thursday: Does the board have legal jurisdiction over Jaleski’s complaints?

Town Attorney Maggie Mooney-Portale filed Feb. 5 memos stating the ZBA “does not have the authority under the town code to review the decisions of either the commission or the PZB boards.”

Planning, Zoning and Building Director Alaina Ray said staff informed Jaleski he should take up the issues with an attorney in court but he decided to file the complaints.

Also during this week’s ZBA meeting, Moore’s Stone Crab Restaurant co-owner Alan Moore will seek to reduce setbacks.

That request is contingent on the PZB and commission’s approval to revert the zoning of the property at 800 Broadway to its original commercial zoning.

On Feb. 17, PZB will review the request, which Moore seeks to redevelop the restaurant in partnership with investors Mark Caragiulo and Tom Leonard.
