Country Club Shores owners fined for non-compliant dock

The Longboat Key Code Enforcement Board assessed a $1,200 administrative fee to the owners of the home at 1075 Bogey Lane in Country Club Shores, and the owners could face additional fines if a dock on the property is not brought into compliance by April 22.

Code Enforcement Officer Heidi Micale told the board at its April 12 meeting that the dock at the property, which is owned by Enrique and Rosario Pointe, of El Paso, Texas, was constructed without a building permit, is in violation of the 10-foot setback requirement and was improperly attached to the adjacent property at 511 Putting Green Lane.

Micale said the case has been open since Jan. 14, when the owners of the Putting Green Lane home inquired about the dock. After inspection, Micale found that the dock was not permitted and was in violation of town codes. A paved patio area adjacent to the dock, retaining wall and brick stairs were also installed without a permit.

Micale attempted to make contact with the Pointes and spoke to their nephew, who said that he had contacted a dock company to bring the structure into compliance. By Feb. 8, Micale hadn’t received a permit. On March 4, Micale spoke to Enrique Pointe and told him that the matter could be resolved if a stipulation agreement was signed before the March 8 Code Enforcement Board hearing.

Mark Liebel, of Duncan Seawall, later contacted Micale to tell her that he would be submitting a permit to bring the non-compliant dock into compliance. Micale forwarded the issue to the Code Enforcement Board when the stipulation agreement wasn’t signed by the March 8 meeting.

Liebel, whose company did not install the dock, attended the April 12 hearing on behalf of the Pointes.

“From what I understand … (Enrique Pointe) did not realize he needed to permit the dock when he put it in,” Liebel said.

Liebel submitted a permit, which has been approved, to correct the dock and has received a deposit from the Pointes. However, his company is waiting for the Pointes to return a notice of commencement before work can begin.

Assistant Town Attorney Kelly Martinson said that to become compliant, the Pointes must submit a permit to tear down the original dock before the new one can be installed.

If the dock is not compliant by April 22, the Pointes could be fined up to $250 per day.
