L'Ambiance, Sanctuary dismiss de novo challenge

The L’Ambiance and Sanctuary condominium associations filed voluntary motions for dismissal in their de novo challenge of the Longboat Key Club and Resort and the town.

Attorney Robert Lincoln, who represents the associations and the Islandside Property Owners Coalition (IPOC), said that IPOC will move forward as the sole plaintiff in the case. The associations remain as plaintiffs in the writ of certiorari challenge.

In October, Judge Charles Roberts denied a request from the Longboat Key Club and Resort to dismiss a petition for a writ of certiorari filed by IPOC and the associations. Key Club attorneys had argued in their request that IPOC lacked legal standing to bring the lawsuit and that the L’Ambiance and Sanctuary condominium associations did not participate in quasi-judicial hearings, therefore, could not appeal the ruling.

Because of the dismissal, the associations felt confident about IPOC proceeding with the case as their representative, according to Lincoln.
