Driver involved in bicyclist's death reports attention disorder

LAKEWOOD RANCH — Lindsay Damery, the driver involved in an April 4 traffic accident that led to the death of 83-year-old East County resident Donald Mader, was not distracted and not under the influence of any alcohol or controlled substance, according to a Florida Highway Patrol homicide investigation report released Aug. 8.

The report, though, states Damery claims she suffers from an attention deficit disorder. Damery told two officers on the scene after the accident that she did not take her attention deficit disorder medication that morning and was also suffering from a lack of sleep.

Damery, 22, lost her driver’s license for six months last week.

Damery, also an East County resident, was cited Aug. 6 in Manatee County Traffic Court for the suspension of her license. Damery was already fined $1,000 and ordered to pay $101 in court costs. She must also attend 12 hours of driving school but won’t receive any point on her driver’s license.

A homicide investigation completed by the Florida Highway Patrol last month concluded there will be no criminal charges filed against Damery.

Mader sustained serious injuries April 4 and died April 5 at Blake Medical Center, in Bradenton, after being struck by a vehicle while riding his bicycle at the intersection of Parkside Place and Lakewood Ranch Boulevard.His wife, Joyce, 81, sustained minor injuries in the accident.

Joyce Mader sued Damery in Manatee County Court, seeking a jury trial for damages against Damery for mental suffering and costs associated with her husband’s burial and medical costs.
