For the second time in two months, Planning, Zoning and Building Director Monica Daigle has deemed the Longboat Key Club and Resort’s $400 million Islandside application complete.
This time, the application makes no reference to modifications of Longboat Club Road or the Islandside guardhouse, which The Longboat Key Association disputed in the previous application.
Daigle made her ruling in a memo sent to resort counsel dated July 16, despite the fact that Icard Merrill attorney Robert Lincoln argued that the plan includes curb cuts that need to be performed to the road.
Lincoln believes The Longboat Key Association (owner of Longboat Club Road) would need to sign off the application to make it complete.
Town special counsel attorney Nancy Stroud, however, informed Daigle that curb cuts to a road do not require the owner of the road to sign the application.
“We are pleased that Monica Daigle has determined the Club’s ODP application to be complete, and that she and her legal counsel, Nancy Stroud, considered and rejected the arguments of attorney Robert Lincoln that the joinder of the Road Association was required,” said Michael Welly, general manager of the Key Club, in a press release July 22.
The application will now be sent to the planning board for its review this fall. The planning board will be provided a minimum of 10 days to review and consider the application prior to a public hearing.
The decision to deem the application complete can be appealed like it was earlier this year by community associations within the club’s gates. If it’s not appealed, it will be forwarded to the planning board for review, and, then, the Town Commission for consideration for final approval.
