Town attorney starts office hour policy

Town Attorney Maggie Mooney-Portale is starting an office hour policy with Longboat Key commissioners.

In an email to commissioners Thursday, Mooney-Portale said “the purpose of establishing these hours is to make myself available to meet with commissioners for in person discussions. It is my hope that these hours will make it convenient for commissioners to discuss any legal issues or concerns you may have with me.”

Some Longboat Key commissioners have questioned the legal advice they have received from Mooney-Portale.

At the March 17 workshop, the commission discussed the town attorney and decided she needed more time before she is evaluated because she was on maternity leave.

Office hours for commissioners will be 1:30 p.m. to 4 p.m. Monday and 9:30 a.m to 12:30 p.m. Wednesdays.

Mooney-Portale will bring a laptop with her and set up an office, most likely in the commission office. Office hours will begin Wednesday, April 9.

    I applaud Ms. Mooney-Portale's choice to take maternity leave.

    That said, and without assessing the merits of the performance-related situation, I would like to pose three short questions that may be of interest to tax payers:

    In accordance with the Town of Longboat Key Legal Services Agreement, the Firm [Persson and Cohen, P.A., Attorneys at Law] will perform all Town Attorney retainer services for a monthly fee of $20,312.50/month. During the months of absence for maternity reasons, based on previous announcements presumably some time in November through some time in January, Mr. Persson was “to fill in”.

    Did we pay full remuneration for the months in question, especially in light of the fact that Mr. Persson has a full-time commitment as the attorney for the city of Venice for which he and his firm are receiving fees in the neighborhood of $248,625 per year for routine legal services.

    Is anybody monitoring expenses??? Does anyone address leave/absence and other routine human resource issues in legal services and other contractual agreements or are the attorneys writing them in a vacuum and the town acts as a signatory only?

    Exactly which routine legal services other than the projected 5.5 hours per week for "in-person discussions" are being performed by the Firm every month and who tracks this?
