Islandside project alterations are allowed

The Longboat Key Town Commission has the power to approve the Islandside renovation-and-expansion project that the Longboat Key Club and Resort proposed at the end of the month.

Town Attorney David Persson sent an e-mail to the commission Tuesday, June 15, explaining that any commissioner can make an amendment to the ordinance on second reading at 5:01 p.m. Monday, June 28.

According to what Persson released, the commission could approve on second reading an amended ordinance that even includes the golf course condominium towers, which were removed in the ordinance that was approved on first reading this week.

Wrote Persson: “I have been asked about the legal standard for offering amendments to an ordinance on second reading and when those amendments would result in a ‘substantial or material change’ such that another advertised hearing would be required.”

Ordinance language submitted by Persson shows the project the club submitted on Monday could be approved on June 28 and would not be deemed a “substantial or material change.” The club’s project, or a different project the commission agrees to, could be approved on second reading on Monday, June 28, or Wednesday, June 30.

Mayor George Spoll noted there is still “an opportunity for approval to be modified.”
