A court hearing scheduled for Tuesday, Feb. 16, to determine whether County Commissioner Joe Barbetta had to surrender his computer has been canceled.
A legal consultant for two citizens groups suing Barbetta says that an agreement may be reached soon that would allow his computer to be examined without the need for a judge’s intervention.
The lawsuit claims that the commissioner has been conducting business, specifically on spring-training baseball, using his personal e-mail account.
The groups say when they made a public-records request for all of Barbetta’s e-mails, at least 28 from his personal account were not provided.
Barbetta said he has nothing to hide and thought he had provided all the relevant e-mails.
